Law of Turkmenistan On amendments and additions to the Law of Turkmenistan "On migration"

. Introduce into the Law of Turkmenistan "On migration" adopted on March 31, 2012 (Register of the Mejlis of Turkmenistan, 2012, No. 1, article 41; 2013, No. 2, article 29, No. 4, article 83; 2014, No. 2, Art. 90; 2015, No. 1, Art. 38; 2016, No. 1, Art. 52, No. 3, Art. 120; 2017, No. 1, Art. . 20 and 39, No. 2, Art. 81, No. 4, Art. 136; 2018, No. 2, Art. 57; 2019, No. 4, Art. 78), the following additions and changes:
1) Article 1 shall be supplemented with the following clause:
“21) a party receiving foreign citizens, stateless persons in Turkmenistan - individuals inviting for a temporary stay in Turkmenistan and (or) receiving foreign citizens, stateless persons, a citizen of Turkmenistan residing in Turkmenistan, a foreign citizen or a stateless person, persons carrying out entrepreneurial activities without forming a legal entity, as well as legal entities, including state bodies, local self-government bodies, diplomatic missions or consular offices of foreign states in Turkmenistan, representative offices of international organizations in Turkmenistan or representative offices of foreign states at international organizations located in Turkmenistan, branch or representative office of a legal entity. ";
2) in article 6:
the paragraph of the second part of the second shall be deleted;
after part two, add the following part:
"21. Foreign citizens, stateless persons residing in Turkmenistan on the basis of a residence permit, and stateless persons residing in Turkmenistan on the basis of a stateless person's certificate, are subject to registration in the manner prescribed by the legislation of Turkmenistan, and they are issued a residence permit in the manner prescribed by the legislation of Turkmenistan for citizens of Turkmenistan. ";
3) in part one and paragraph four of part two of Article 7, the words "through checkpoints on the State Border of Turkmenistan open for international traffic" and "through checkpoints located on the State Border of Turkmenistan open for international traffic" shall be replaced with the words “Through checkpoints on the State border of Turkmenistan, open for international traffic”;
4) in clause 7 of part nine of Article 10 the words “through the checkpoint” shall be replaced by the words “through the checkpoints”;
5) in part three of Article 12:
in the seventh paragraph, the words “at the posts of migration control of checkpoints of the State Border of Turkmenistan” shall be replaced by the words “at the migration posts of checkpoints on the State Border of Turkmenistan”;
in paragraph twelve, the words “at the posts of migration control on the State Border of Turkmenistan” and the words “through the post of migration control at the State Border of Turkmenistan” shall be replaced, respectively, with the words “at the migration posts of checkpoints on the State Border of Turkmenistan” and “through the migration post of checkpoints on the State Border Turkmenistan ";
in paragraphs thirteen and fourteen, the words "at the posts of migration control on the State border of Turkmenistan" shall be replaced by the words "at the migration posts of checkpoints on the State border of Turkmenistan";
in paragraph sixteen, after the words “in this zone,” add the words “if the period of their stay in Turkmenistan does not exceed five working days (except for the day of entry into the country), their registration is carried out in a simplified manner only at the migration posts of checkpoints on the State Border Turkmenistan, if it exceeds five working days, "and after the word" registered ", add the words" in the migration service ";
6) paragraph ten of the first part of Article 17 shall be stated in the following wording:
“10) continuous residence outside Turkmenistan for more than one year, except for cases when he could not enter Turkmenistan due to the circumstances of his stay in a foreign state beyond his control;”;
7) the title of Article 21 shall be stated as follows:
"Obligations of the parties accepting foreign citizens, stateless persons in Turkmenistan";
8) in the second part of Article 24 the words "through checkpoints located on the State border of Turkmenistan, open for international traffic" shall be replaced by the words "through checkpoints on the State border of Turkmenistan, open for international traffic";
9) in Article 28:
part one shall be supplemented with the following paragraph:
"The procedure for issuing and issuing diplomatic and service passports of citizens of Turkmenistan, the rules for their use, as well as the sample and description of the passport are approved by the President of Turkmenistan.";
in the first paragraph of the second part, after the words "this article," add the words "or their invalidity";
10) in Article 29:
to state part eight in the following edition:
"8. Persons accepted into the citizenship of Turkmenistan or restored in it on the basis of the Decree of the President of Turkmenistan, passports are issued in the manner prescribed by this Law. " ;
part ten shall be supplemented with the following paragraph:
"In case of loss of a passport, it is invalidated, and a new passport is issued in its place in the manner prescribed by the legislation of Turkmenistan.";
11) part two of Article 34 shall be supplemented with the following paragraph:
"The procedure for processing and issuing documents to citizens of Turkmenistan to leave Turkmenistan for permanent residence is approved by the State Migration Service of Turkmenistan.";
12) in Article 42:
the title of the article should be stated as follows:
"Registration of citizens of Turkmenistan, foreign citizens, stateless persons residing in the territory of Turkmenistan, at the place of residence and place of stay";
the paragraph of the second part of the second shall be stated in the following edition:
"The procedure for registration of registration for citizens of Turkmenistan, foreign citizens, stateless persons residing in the territory of Turkmenistan at their place of residence is approved by the President of Turkmenistan.";
13) in the content of Article 49 the words “invited to Turkmenistan” shall be replaced by the words “receiving in Turkmenistan”.
II. This Law comes into force from the day of its official publication.
